1. Status of this draft
These are draft rules for using Mailwright. They sit with the Terms of Service. They are not an approved policy, and they do not choose a governing law.
Not stated in the product, and not filled in by this draft: the operator’s legal name, registered address, governing law, and court. A lawyer has to supply them. Do not treat this page as a signed contract.
2. The law that applies to your mail
You are responsible for the list, the content, the mailbox, and the law that applies to each recipient. Mailwright does not review every campaign before it sends, and an approval step inside the product is a review by a person on your team, not a legal opinion.
3. Cold email
Sending mail to someone who did not ask for it is lawful in some situations and unlawful in others. It depends on the countries involved, the kind of address, whether the message is commercial, and whether you have a relationship or another lawful basis. Cold email is not universally legal, and it is not universally illegal. Mailwright does not decide that for a campaign, and using the product does not create permission.
4. Lists
Do not upload addresses you are not allowed to mail. Do not hide who the message is from. Do not use a purchased or scraped list unless you are sure the law that applies to those people allows that send. The product will send to the addresses you launch, aside from addresses already suppressed.
Verification checks whether an address looks worth mailing (syntax, domain, MX, and a cautious SMTP probe when that probe is enabled). A passing result is not permission to mail the person, and it is not a prediction of the inbox folder.
5. Phishing, malware, and deception
- Do not impersonate a person, company, or mailbox you are not allowed to use.
- Do not send mail whose purpose is to collect passwords, payment cards, or one-time codes.
- Do not send malware, or links and attachments whose purpose is to install malware or to steal credentials.
- Do not forge headers to pretend a message came from a domain you do not control.
- Do not use the product to harass a person or to continue after they have opted out.
6. Opt-out and suppression
Campaign sends can include an RFC 8058 List-Unsubscribe header and an unsubscribe page. When the recipient completes it, the product records an unsubscribe, suppresses that address, and stops further campaign sends to it. A hard bounce is also stored as a reason to suppress. You can add or remove suppression entries in the workspace. Complaint handling, when a complaint event is recorded, uses the same suppression path.
Suppression is a product control. It does not prove that every opt-out statute that applies to you has been satisfied. You still need a working unsubscribe path in the mail you send, and you should not import a suppressed address into a new campaign in order to mail them again.
7. Follow-ups stop on reply
Follow-up steps after the first message are dropped when the lead is marked replied or converted. A stopped lead is not sent. Reply detection uses IMAP. If you have not saved a working IMAP login, the product cannot see the reply and cannot stop the sequence because of it. Do not rely on follow-ups to police consent.
8. Mailboxes
Connect only mailboxes you are allowed to use. Gmail sending permission is send-only. An IMAP app password reads inbox mail and is stored encrypted. Do not put your Mailwright password into the mailbox password field. Do not share mailbox secrets in a campaign body.
9. No placement guarantee
You may not advertise, inside or outside the product, that Mailwright guarantees the inbox, a sender score, or delivery. Seed mailbox tests, when configured, report a folder for those mailboxes only.
10. If these rules are broken
The operator may suspend an account. Suspended accounts cannot sign in. The product can also pause a campaign. This draft does not set a cure period. Write to support if you think a suspension is a mistake.
11. Contact
Report abuse to support@nxtfluencez.com. Include the message headers you have and the account email if you know it.
